제19차 유엔인권이사회 패널토론 중.

2011년 6월 17일 제17차 유엔인권이사회에서 처음으로 성적지향과 성별정체성에 대한 결의안을 채택하였습니다. 이에 따라 제19차 유엔인권이사회 "인권, 성적지향, 성별정체성" 패널토론이 진행되었습니다. 

이 중에서 트랜스남성이자 트랜스젠더 인권활동가인 Justus Einsfeld의 연설이 간결하고도, 마음을 울리길래 이렇게 올려봅니다.

개인적으로 이 친구는 2011년도 3월 뉴질랜드 Outgames Conference에서 만났는데요, 전세계를 뛰어다니며 트랜스젠더 권익 운동을 위해 열심히인 활동가였습니다.:) (사실 핸섬한 것이 딱 식이 되어서, 잘생겼다는 이야기를 슬쩍 단번에 퇴짜 맞았답니다 ㅎㅎㅎ. 웃으면서 바로 남자친구 사진을 보여주더군요. 중후하게 멋진 느낌의 정신과 의사였어요. 이런 핸섬스런 커플같으니라고 ㅠㅠ 작년에 파트너랑 결혼 했다는 소식이 들렸습니다. 다시 한번 축하 축하)

그 때 컨퍼런스에서는 아침 시작 때마다 실시간으로 결의안 채택에 찬성한 국가를 새로이 불러주었는데, 여러 국가의 활동가, 당사자 등이 모인 자리에서의 그 열기가 잊혀지지 않네요. 한 활동가가 한국 정부 관계자가 군형법 문제로 찬성하기를 주저하고 있다는 이야기가 들어왔다고, 한국 국내에서 정부에 대한 항의와 움직임이 필요하다고 전달했더랬죠. 그 때 국내 단체들에 내용 포워딩한 것 외에 다른 것을 못해서 나의 미약함에 슬퍼했지만.. 여튼 한국도 채택했어요 결국.:) 

원문과 번역문 올립니다. 번역은 자연스럽게 읽히게 의역했어요. 틀린 번역 지적해주세용. 특히 they fail us를 '그들이 우리를 실망하게 한다'로 해야 할지, '그들이 (우리에 대해) 실패했다'라고 해야 할지 고민이네요.(게다가 번역해놓고 보니 원문의 감동이 전달이 잘 안되네요.. ㅠㅠ 번역은 제2의 창조 ..ㅜ)

 

2012.3.8 제19차 유엔인권이사회 '인권, 성적지향, 성별정체성' 패널 토론, 트랜스젠더 활동가  GAT*E 공동대표 Justus Einsfeld의 연설  이 패널이 구성될 수 있도록 도와준 서아프리카와 다른 여러 나라들에 감사를 표합니다. 인권이사회에서 성별정체성이 아젠다로 설정된 것은 사상 처음이며, 마땅히 그러할 때가 되었다고 할 수 있습니다. '트랜스* 피플'은 성별정체성에 대한 많은 표현들에 대응하기 위하여 사용하는 용어(placeholder)입니다. 트랜스* 피플은 어떤 지역에서는 히즈라, 펜키드, 카토이, 파아타마, 제니스, 마후, 딜바, 트라베스티, 트랜스섹슈얼 혹은 트랜스젠더로 알려져 있습니다. 어떠하든간에 우리들은 당신들의 모든 문화와 사회의 일부였었고, 또 언제나 그러할 것입니다. 이 세계의 많은 트랜스*피플은 폭력과 차별을 경험합니다. 트랜스* 피플은 거리와 가정에서, 모르는 사람에게 혹은 자신의 가족에게 폭행을 당하고, 강간당하고, 살해당합니다. 정부가 우리들이 우리들이기 때문에 박해하거나, 적절한 직업을 가질 기회가 부족하여 성노동이나 지하시장으로 유입될 수 밖에 없게 될 때에, 정부는 우리를 실망시킵니다. 또한, 신분증서에 우리의 정체성이 반영되지 못하게 하거나, 반영되기 위한 요건으로 불임을 요구하는 것 역시 정부는 우리에게 실망을 안겨주며, 제 국가의 정부도 저에게 역시 그러했습니다. 독일의 헌법재판소가 이를(생식능력제거 요구) 부정하는 판단을 내렸으나, 아직까지 대부분의 국가가 여전히 이 요건을 유지하고 있습니다. 사회와 가족들이 우리를 거리로 내몰고, 그것이 종종 어린 시절에 이루어지게 됨으로써 우리의 교육받을 권리가 부인되고, 우리가 가질 수 있고 가져야 마땅한 일자리에서 내몰릴 때, 우리 사회와 가족들은 우리를 실망시킵니다. 보건의료체계가 '그런 사람들은 치료하지 하지 않기' 때문이라는 이유로 부러진 팔이나 총상을 치료하지 않은 채로 우리를 집으로 돌려보낼 때 보건의료체계는 우리를 실망시킵니다. 또한 우리가 온전히 자신으로 있기 위해 필요한 조치들에 대해 그것이 의료적으로 필요하지 않다고 주장하고, 그 결과 많은 사람들이 암시장에서 호르몬을 구입하고, 해로운 공업용 실리콘을 사용하거나 야매로 수술을 받게되는 것 역시 그러합니다. 인권매커니즘이 우리들을 그 보호와 지원을 받아야할 사람으로 인식하지 않을 때, 인권매커니즘은 우리를 실망시킵니다. 트랜스*피플 모두에게 공통적으로 적용되는 것이 한 가지가 있습니다- 우리는 모두 인간으로 태어나 인권을 가지고 있으며, 그러한 인권은 유엔인권위원회에서 보호해야 할 인권이라는 것입니다.

It is the first time in history that gender identity is listed as an agenda point at the Human Rights Council and it is high time. ‘Trans* people’ is a term which we use as a placeholder for many expressions of gender identities. Trans* people are known in some places as hijra, pengkid, kathoey, fa’atama, xanith, māhū, dilbaa, travesti, transsexual, or transgender. We always have and always will be part of all of your cultures and societies in one way or another. Many trans* people around the world experience violence and discrimination. Trans* people get beaten, raped and murdered in the streets and in our homes, by strangers and by our own families. Our governments fail us when they persecute us for who we are, or when we are forced into sex work and underground economies for lack of proper job options. Our governments also fail us when they deny us identity papers that reflect our identities or when they demand that we be sterilized to obtain one, like my government did to me. Germany’s Constitutional Court has since outlawed the practice but the vast majority of countries still hold on to these requirements. Our societies and families fail us when they kick us out in the streets, often early, when they deny us the education that we have a right to, when they deny us the jobs we could and should be getting. Our healthcare systems fail us when they send us home with a broken arm or a gunshot wound because they ‘don’t treat people like that’. They also fail us when they claim that treatments we need in order to feel whole are not medically necessary – pushing many of us to quacks for black-market hormones, harmful injections of industrial-grade silicone or backyard surgery. Human rights mechanisms fail us when they do not recognize us as people worthy of their protection and support. Trans* people have one thing in common: we are all born human and are therefore born with human rights that this Council needs to protect.
